Any person who was a tenant of the Housing Association prior to 2 January 1989 will still have the original Right to buy as per the 1980 Tenants Rights Act. The Housing (Scotland) Act 1988 removed the Right to Buy for Association tenants.
As a result of the Housing (Scotland) Act 2001 substantial changes were made to (RTB) and these changes came into force in September 2002. In general the level of discount has changed. This has been reduced and the maximum discount for a flat is 35% after a qualifying period. The table below is a guide to the qualifying period. More information is available from our office.

With the introduction of the Modernised Right to Buy the Scottish Government provided a lead in period of until 2012 before Housing Associations would process purchases under the new scheme.
